ALJ GRANT issues ruling: UE 115 and UE 116 DISPOSITION: PRESENTATIONS TO BE GIVEN MARCH 22 At the December 12, 2000 Consolidated Scheduling Conference, parties selected two dates for the Commission to hold a Special Public Meeting for opening presentations in these dockets. If the Commission desired presentations that focused primarily on the restructuring proposals filed by PGE and PacifiCorp, the parties agreed on January 9, 2001. If, however, the Commission wanted to hear from the parties after Staff and intervenors had also filed testimony in the cases, the parties selected the date of March 22, 2001. The Commission has considered the selected dates and decided that it would be more useful to hear opening presentations on March 22, 2001. Accordingly, notice is hereby given that the Commission will hold a Special Public Meeting as follows: DATE: March 22, 2001 TIME: 9:30 a.m. PLACE: Public Utility Commission Main Hearing Room, 1st Floor 550 Capitol Street NE - Ste. 215 Salem, OR 97301-2551 This meeting will also be noticed in the Commission's regular Notice of Public Meetings.   Description
ALJ LOGAN issues PREHEARING CONFERENCE REPORT On October 24, 2000, a prehearing conference was held in this docket for the purpose of identifying parties, establishing a procedural schedule and discussing other preliminary issues. Petitions to intervene previously were filed by PG &E Energy Group, Northwest Energy Coalition, Northwest Natural and Renewable Northwest Project. No participant objected to the petitions. Upon review, I find that all petitioners have sufficient interest in the proceeding and that their appearance and participation will not unreasonably broaden the issues, burden the record, or unreasonably delay the proceeding. All petitions are granted. See OAR 860-013-0021. Additionally, the Citizens' Utility Board filed a notice to intervene, allowing its participation as a party in this matter. See ORS 774.180. To facilitate future processing of this case, the following schedule was adopted: Petitions to Intervene Due=December 15, 2000 Staff and Intervenor Settlement Proposals Due=January 24, 2001 Settlement Conference=February 8 - 13, 2001 Staff & Intervenor Testimony Due=March 12, 2001 PacifiCorp Rebuttal Testimony Due=April 23, 2001 Surrebuttal Testimony Due=May 16, 2001 Sursurrebuttal Testimony Due=May 23, 2001 Hearing=May 29 - 31, 2001 Documents must be postmarked by the filing dates. Additionally, the parties agreed that discovery requests would not be made of PacifiCorp between March 12 and April 23, 2000, to allow PacifiCorp time to focus on its rebuttal testimony. PacifiCorp asked that issuance of a standard protective order be held in abeyance until it could determine if it needed to file for a special protective order, similar to the filing that will be made by Portland General Electric in UE 115. Counsel for PacifiCorp will inform the Commission by October 30, 2000 as to how it wishes to proceed. Copies served via mail to UE 116 service list 10/26/00.

Date: 9/18/2000 Action:  LAW JUDGE RULING/MEMORANDA
  Description
ALJ Logan issues ruling. On September 14, 2000, PacifiCorp filed a Motion for Extension of Time under OAR 860-014-0093 along with a request for expedited treatment of its motion. PacifiCorp asked the Commission for an extension of time in which to file cost unbundling information (from October 1 to November 1, 2000) and its resource plan (from November 1 to December 1, 2000). PacifiCorp filed this motion on the parties of record in its most recent rate filing, docket UE 111. On September 15, 2000, the Commission informed PacifiCorp that the motion should be served on the members of the general electric service list. Service was accomplished on September 15, 2000 and a faxed copy of the motion with service list was received on September 18, 2000. OAR 860-013-0050(3) states that a written response to a motion shall be filed within 15 days of service of the motion, unless otherwise specified by the Administrative Law Judge. Due to the limited amount of time, written responses are due within five days of service of the motion. It is not expected that a hearing will be needed, so it is anticipated that an order will be issued prior to October 1, 2000. Copies served on general electric service list.
