Staff seeks an immediate ruling that the "quiet time" previously designated in this case does not apply to requests for information related to return on equity (ROE) testimony. In the original schedule, Staff and Intervenors had agreed not to submit data requests to PGE during the seven-week period between the filing of Staff and Intervenor opening testimony and the filing of PGE's rebuttal testimony (February 20 to April 10). Given the tight procedural schedule for the filing of ROE testimony, I agree with Staff that this discovery dispute should be resolved as soon as possible. Accordingly, I find that good cause exists to deviate from the normal time provided for the filing of a reply to a motion. See OAR 860-011-0000(6). Any party that would like to file a reply to Staff's request should do so by the close of business Wednesday, March 14, 2001. I will issue a ruling the following day, March 15, 2001.
