ALJ Petrillo's 1/8/01 Prehearing Conference Report; Disposition: Procedures Adopted to Terminate Docket UM 975 and Initiate Rulemaking Proceeding; stating: Based upon recent developments at the Federal Communications Commission (FCC) and concerns expressed in the reply comments filed by the parties, the Administrative Law Judge (ALJ) recommended terminating this investigation and initiating a rulemaking proceeding to determine whether the Commission should implement collocation requirements in addition to, or in lieu of, the minimum national standards promulgated by the FCC in its Advanced Services Docket. The parties agreed to the ALJ's proposal without objection, and approved the following procedural schedule: 1. Thirty (30) days after the FCC issues its order addressing the pending petitions for reconsideration of FCC Order No. 00-297, the parties may file supplemental comments addressing any new or revised collocation requirements adopted by the FCC. The parties may also respond to the reply comments filed in this proceeding on December 15, 2000. The supplemental comments are for the purpose of identifying new issues, as well as any issues that may be resolved as a result of the FCC's decision. It is unnecessary to reiterate arguments raised in prior rounds of comments. Filing supplemental comments is optional. 2. Forty-Five (45) days after the supplemental comments are filed, Staff will circulate draft proposed rules specifying state collocation requirements in addition to, or in lieu of, the minimum national standards promulgated by the FCC. 3. Fifteen (15) days after Staff circulates its draft proposed rules to the parties (or as soon thereafter as possible), a scheduling conference will be held to adopt a proposed procedural schedule for the rulemaking docket. 4. As soon as possible after the scheduling conference, Staff will place an agenda item on the Commission's regular public meeting calendar. Staff will request that the Commission terminate this investigation docket (UM 975) and initiate a new rulemaking docket to consider Staff's proposed collocation rules. Staff will propose that the rulemaking docket proceed in accordance with the timeline adopted at the scheduling conference and that the proposed rules accompany the rulemaking notice published by the Secretary of State. In reviewing the comments, I note that some parties have recommended changes to the staff guidelines (or suggested additional guidelines) without including proposed language. For purposes of the reply comments due December 15, 2000, each party should: · Clearly indicate all recommended changes to Staff's proposed generic collocation guidelines. All additions/deletions should be set forth in legislative format. · Include proposed language for any guidelines in addition to those recommended by Staff. Schedule Change. After the reply comments are filed on December 15, 2000, the next step in the schedule calls for a telephone conference on Janury 8, 2001. At the conference, it will be necessary to determine the remaining issues in dispute, the position of each party on those issues, and the remaining procedural schedule for this docket. In my opinion, those tasks can be accomplished more efficiently if the parties convene in-person.
