DISPOSITION: REPLY TO STAFF'S MOTION DUE MARCH 14
On March 12, 2001, Staff filed a motion to clarify the schedule in this proceeding. Staff seeks an immediate ruling that the "quiet time" previously designated in this case does not apply to requests for information related to return on equity (ROE) testimony. In the original schedule, Staff and Intervenors had agreed not to submit data requests to PGE during the seven-week period between the filing of Staff and Intervenor opening testimony and the filing of PGE's rebuttal testimony (February 20 to April 10).
Given the tight procedural schedule for the filing of ROE testimony, I agree with Staff that this discovery dispute should be resolved as soon as possible. Accordingly, I find that good cause exists to deviate from the normal time provided for the filing of a reply to a motion. See OAR 860-011-0000(6). Any party that would like to file a reply to Staff's request should do so by the close of business Wednesday, March 14, 2001. I will issue a ruling the following day, March 15, 2001.

At the December 12, 2000 Consolidated Scheduling Conference, parties selected two dates for the Commission to hold a Special Public Meeting for opening presentations in these dockets. If the Commission desired presentations that focused primarily on the restructuring proposals filed by PGE and PacifiCorp, the parties agreed on January 9, 2001. If, however, the Commission wanted to hear from the parties after Staff and intervenors had also filed testimony in the cases, the parties selected the date of March 22, 2001.
