ORDER

DISPOSITION: DOCKET OPENED AND CASE CONSOLIDATED WITH UW 65

At its July 6, 1999, Public Meeting, the Public Utility Commission of Oregon (Commission) approved a Staff recommendation to open a docket to establish fair and reasonable wastewater rates for Juniper Utility Company (Juniper), and to consolidate this case with the current Juniper water rate case, UW 65.

Staff explained in its Staff Report that House Bill 2681 was signed into law on June 23, 1999, and that the area served by Juniper would be annexed by the City of Bend on July 1, 1999.

House Bill 2681 amended ORS 757.005(1)(a)(A) to include in the definition of "public utility" under this section the following: "‘Public utility’ includes a privately owned water utility that provides wastewater services inside the boundaries of a city, regardless of the number of customers receiving wastewater services."

The Commission finds that under House Bill 2681, Juniper’s sewer services will now fall under the jurisdiction of the Commission. The Commission therefore finds that this docket should be opened to establish fair and reasonable wastewater rates for Juniper. The Commission also, pursuant to OAR 860-014-0050(1)(e), takes official notice of the fact that the tariffs filed by Juniper in its water rate case, docket number UW 65, include rates and rules and regulations for sewer services as well. A copy of the Staff Report is attached to this Order as Appendix A.

ORDER

IT IS ORDERED that:

  1. Docket No. UW 68 shall be opened for the purpose of establishing fair and reasonable wastewater rates for Juniper Utility Company.
  2. Docket No. UW 68 shall be consolidated with Juniper Utility Company’s current water rate case, Docket No. UW 65.
