ORDER

 

DISPOSITION: AMENDED APPLICATION FOR ALLOCATION OF EXCLUSIVELY SERVED TERRITORY APPROVED

On March 11, 1999, the Central Lincoln People’s Utility District (CLPUD) filed an application with the Public Utility Commission of Oregon (Commission), for an allocation of exclusively served territory, pursuant to ORS 758.435 and OAR 860-025-0020.

Notice of the application was published in the Roseburg News Review on March 17, 1999; in the Coos Bay World on March 17 and March 24, 1999; in the Umpqua Post on March 17 and March 24, 1999; and in the Roseburg Courier on March 18 and March 25, 1999.

CLPUD filed a motion to amend its application on May 24, 1999. CLPUD requests that Exhibits A, A-1, B, and C attached to its application be amended to reduce the amount of territory for which CLPUD seeks allocation in this docket. CLPUD further requests that the amendments relate back to the original date of filing for the application and be deemed effective as of March 11, 1999.

On June 22, 1999, Commission Staff and CLPUD entered into a Stipulation for Approval of CLPUD’s Application for an Allocation of Exclusively Served Territory. In the Stipulation, the parties identified the documents to be included in the administrative record for Docket UA 68 and agreed that the Motion to Amend should be granted and the application, as amended, should be approved. The Stipulation is attached as Exhibit A to this Order.

We have reviewed the parties’ Stipulation and the Points and Authorities submitted in support of CLPUD’s motion to amend. We find that Exhibits A, A-1, B, and C to the application in this docket should be amended as requested by CLPUD and such amendments should be deemed effective as of March 11, 1999.

We have also reviewed the administrative record and the Stipulation of the parties. We find that CLPUD is exclusively serving the territory covered by the application in UA 68, as amended. The application of CLPUD for an allocation of exclusively served territory should be approved.

A metes and bounds description of the CLPUD exclusive service territory is attached to this Order as Exhibit B.

ORDER

IT IS ORDERED that:

The motion of Central Lincoln People’s Utility District to amend its application is granted.

The amended application of Central Lincoln People’s Utility District for an Allocation of Exclusively Served Territory is approved.
