ORDER

DISPOSITION: DOCKET CLOSED

On April 7, 1998, at our Public Meeting, we determined that it appeared that Juniper Utility Company (JUC) is a public utility under ORS 757.005, and opened an investigation. See Order No. 98-177. On December 17, 1998, we issued Order No. 98-529 asserting rate and service jurisdiction over Juniper as a public utility. On December 22, 1998, JUC requested a hearing to determine whether Order No. 98-529 should continue in effect. A hearing was scheduled to accommodate that request. On January 28, 1999, JUC filed a document withdrawing its request for a hearing to determine whether Order No. 98-529 should continue. The hearing then was canceled. On March 24, 1999, JUC filed tariff schedules designed to change the rates it charges its customers. That rate case has been assigned docket No. UW 65.

There is no reason to keep this docket open. Fair, just and reasonable rates for JUC will be established in Docket No. UW 65.
