DISPOSITION: INTERCONNECTION AGREEMENT APPROVED

On January 13, 1997, the Commission issued Order No. 97-021 adopting the arbitration decision issued by Arbitrator Thomas G. Barkin on December 13, 1996, in this docket. On April 23, 1997, the Commission issued Order No. 97-149 granting in part reconsideration of Order No. 97-021. On September 29, 1998, the parties filed a draft interconnection agreement and requested that the Commission resolve the disputed issues. On December 8, 1998, the Commission issued Order No. 98-508 setting forth the Commission’s decision on the disputed issues. On December 23, 1998, the parties jointly filed the interconnection agreement signed by AT&T Communications of the Pacific Northwest, Inc., and containing a statement by GTE Northwest Incorporated pursuant to Order No. 98-508.

Section 252(e)(1) of the Communications Act of 1934, as amended by the Telecommunications Act of 1996, requires that any interconnection agreement adopted by negotiation or arbitration shall be submitted for approval to the State commission. Section 252(e)(2)(B) provides that the State commission may reject an agreement (or any portion thereof) adopted by arbitration only "if it finds that the agreement does not meet the requirements of section 251, including the regulations prescribed by the Commission pursuant to section 251, or the standards set forth in subsection (d) of this section."

The Commission concludes that the interconnection agreements meet the requirements of the Act, applicable Federal Communications Commission rules, and relevant state law and regulations, and should be approved.  

ORDER

IT IS ORDERED that the interconnection agreement between GTE Northwest Incorporated and AT&T Communications of the Pacific Northwest, Inc., is approved, effective on the date specified in the agreement.
