DISPOSITION: RATE SCHEDULES SUSPENDED
On July 2, 1998, Hurtley Irrigation System filed rate schedules in Advice No. 1596 to be effective August 1, 1998. The terms of the proposed tariffs were set forth in a Staff Report dated July 14, 1998.
At its July 21, 1998, public meeting, and pursuant to ORS 757.210 and 757.215, the Public Utility Commission of Oregon found good and sufficient cause existed to investigate the propriety and reasonableness of the proposed tariffs. The Commission ordered suspension of the filing pending that investigation.
On July 30, 1998, Order No. 98-309 was entered suspending the tariffs for a five-month period of time. The Staff Report attached to that order noted that the initial suspension was to allow the parties to comply with a court injuction and order. The Staff Report also stated:
If after that time the parties have failed to take the steps necessary to either form an irrigation district or be absorbed by Squaw Creek Irrigation District, the company has agreed to extend the original suspension period an additional six months in order to allow staff time to proceed with the rate case and investigate the companys proposed tariffs. The company also agrees that beginning January 2, 1999, should PUC proceed with its investigation, the rates charged on or after that date may be subject to refund.
ORDER
IT IS ORDERED that the proposed tariffs filed by Hurtley Irrigation District on July 2, 1998, are suspended for an additional period of not more than six months beyond the last day of the initial suspension period set forth in Order No. 98-309.
