 DISPOSITION: MOTION TO CLOSE DOCKET GRANTED

On November 27, 1998, GTE Northwest Incorporated (GTE) filed a motion to close this docket in light of a decision by the Federal Communications Commission (FCC). GTE contends that the FCC has determined that its DSL Solutions-ADSL service offering is an interstate service and, therefore, not subject to state regulation. No party filed a response to the motion, and the time for doing so has passed. See OAR 860-013-0050.

GTE’s motion to close the docket is granted. In CC Docket No. 98-79, the FCC concluded that GTE’s DSL Solutions-ADSL Service, which permits Internet Service Providers to provide their end user customers with high-speed access to the Internet, is an interstate service that is properly tariffed at the federal level. In the Matter of GTE Telephone Operating Cos., GTOC Tariff No. 1, GTOC Transmittal No. 1148, FCC 98-292 (October 30, 1998). Accordingly, there is no reason to keep this docket open.

ORDER
