DISPOSITION: DOCKET CLOSED

On September 25, 1998, the Commission Staff (Staff) filed a motion to close this investigation. Staff notes that the two significant issues in this docket have been resolved. The first issue related to the identification of switches scheduled for initial local number portability (LNP) designation. The Commission resolved that issue in Order No. 98-339, in which it approved a list of switches recommended by the Oregon Exchange Carrier Association.

The second issue related to cost recovery and cost allocation for LNP implementation. Staff notes that this issue has also been settled. On May 12, 1998, the Federal Communications Commission issued its Order No. 98-82 (CC Docket No. 95-116), which appears to preempt the states on LNP cost recovery issues.

Due to these reasons, Staff requests that this investigation be closed. It noted that, should an isolated dispute arise regarding LNP, such as a particular switch implementation date, the Commission may resolve the matter through its complaint and investigation procedures. See generally ORS 756.500 et seq.

No party filed an objection to Staff’s motion. After review, the Commission agrees that no reason exists for keeping this docket open. Accordingly, Staff’s motion is granted.

 ORDER

IT IS ORDERED that the motion to close docket UM 826, In the Matter of an Investigation into a Permanent Database Solution to Local Number Portability, is granted. This docket is closed.
