ERRATA ORDER

DISPOSITION: ORDER NO. 98-241 WITHDRAWN; PROPOSED RULE ADOPTED

At its April 7, 1998, Public Meeting, the Commission adopted a Staff request to initiate a rulemaking regarding annual fees payable by electric utilities. On that same date, the Commission filed a Notice of Proposed Rulemaking with the Secretary of State and subsequently served it on all interested parties.

The notice set out the rule proposed by Staff, and included a Statement of Need, Statutory Authority, Principal Documents Relied Upon, and Economic and Fiscal Impact. The Secretary of State published the notice in the May 1, 1998, Oregon Bulletin.

There were no written comments filed, nor was there a request for a public hearing as a result of the notice.

Public Meeting

The docket was placed on the Commission’s agenda for its June 23, 1998, Public Meeting. Due to a processing error, however, the Commission office issued Order No. 98-241 adopting the proposed rule prior to review at the public meeting. That order, issued on June 12, 1998, was in error and without legal effect. That order is hereby withdrawn.

As originally scheduled, the Commission considered the proposed rule at its June 23, 1998, Public Meeting. After review, the Commission adopted the rule as set forth in Appendix A.

ORDER

IT IS ORDERED that Oregon Administrative Rule 860-011-0022, as set forth in Appendix A is adopted. The rule shall be effective upon filing with the Secretary of State.
