On December 17, 1997, Umatilla Electric Cooperative (Umatilla) filed an application for an order authorizing it to transfer a customer within PacifiCorp’s currently allocated service territory. Umatilla also requested to have that territory allocated to it. The territory to be transferred is adjacent to Umatilla’s facilities. The area to be transferred may generally be described as follows:

The area to be transferred is currently part of PacifiCorp’s service territory. It is located southwest of Stanfield City Boundary, along S. Ott Road and borders the Umatilla River. The area to be transferred is in the west half of the northwest quarter of Section 31, Township 4 north of Range 29.

Umatilla and PacifiCorp agree that Umatilla can provide line extension service to the customer less expensively than PacifiCorp, and that PacifiCorp would transfer the service territory in question to Umatilla.

The Commission published notice of the petition pursuant to ORS 758.420. No request for a hearing was filed. The Commission Staff filed a report supporting the petition based on its conclusion that it is more efficient for Umatilla to serve the area rather than PacifiCorp. Staff’s report is attached as Appendix A.

At its February 3, 1998, Public Meeting, the Commission adopted Staff’s recommendation. The Commission concluded that transferring the identified portion of PacifiCorp’s service territory to Umatilla was appropriate.

ORDER

IT IS ORDERED that the application filed by Umatilla Electric Cooperative is approved. The service territory described in Appendix A is transferred to Umatilla effective immediately.

A request for rehearing or reconsideration must be filed with the commission within 60 days of the date of service of this order. The request must comply with the requirements in OAR 860-014-0095. A copy of any such request must also be served on each party to the proceeding as provided by OAR 860-013-0070(2). A party may appeal this order to a court pursuant to ORS 756.580.
