DISPOSITION: DOCKET CLOSED.
On May 29, 1997, Staff filed a motion to close our investigation into interim number portability rates and costs for GTE Northwest Incorporated (GTE), docket UT 129. Staff asserts that GTEs recently approved tariff Advice No. 592 meets the criteria of competitive neutrality mandated by the Federal Communications Commission (FCC) and that, therefore, no open issues remain in the investigation.
On June 30, 1997, AT&T Communications of the Pacific Northwest, Inc., (AT&T) and MCI Telecommunications Corporation (MCI) filed a joint application for reconsideration of Advice No. 592. AT&T/MCI alleged that they did not receive sufficient notice of GTEs filing prior to its approval. The parties also asserted that Advice No. 592 was not competitively neutral as required by the FCC.
On August 25, 1997, we issued Order No. 97-330. In that order, we denied AT&T/MCIs application for reconsideration based on our determination that the parties had ample notice of the filing to allow them the opportunity to analyze and comment on whether GTEs Advice No. 592 complied with the applicable interim number portability requirements. We also denied Staffs request to close the docket. We concluded that UT 129 should remain open for a limited period of time to allow AT&T and MCI, or any party, the opportunity to submit their own draft tariff that they believed would better serve the policies stated by the FCC. We determined that any party would have 60 days to file a draft tariff with full supporting information for review.
No party has filed a draft tariff, and the time for doing so has passed. Accordingly, pursuant to our prior order, Staffs motion to close docket UT 129 is granted. See Order No. 97-330 at 3.
ORDER
IT IS ORDERED that our investigation into interim number portability rates and costs for GTE Northwest Incorporated, Docket UT 129, is closed.
