DISPOSITION: EXECUTED INTERCONNECTION AGREEMENT APPROVED

On August 4, 1997, the Commission issued Order No. 97-290 adopting as amended the arbitration decision issued by Arbitrator Ruth Crowley on July 3, 1997, in this docket. On September 12, 1997, the parties filed a copy of the interconnection agreement they had executed pursuant to the arbitration. The parties had resolved all issues with the exception of language in sections 2B and 2D dealing with special construction for interconnection facilities. The parties requested oral argument before the Commission on this issue, and a hearing was set for October 15, 1997.

At hearing the parties informed the Arbitrator that they had reached agreement on the disputed provisions and submitted a copy of the language they had agreed to for the sections in question.

Section 252(e) of the Communications Act of 1934, as amended by the Telecommunications Act of 1996, requires that any interconnection agreement adopted by negotiation or arbitration shall be submitted for approval to the State commission. Section 252(e)(2)(B) provides that the State commission may reject an agreement (or any portion thereof) adopted by arbitration only "if it finds that the agreement does not meet the requirements of section 251, including the regulations prescribed by the Commission pursuant to section 251, or the standards set forth in subsection (d) of this section."

The Commission concludes that the interconnection agreement, including the provisions submitted on October 15, 1997, comports with the requirements of the Act, the Federal Communications Commission rules where applicable, and relevant state law and regulations, and should be approved.

ORDER

IT IS ORDERED that the interconnection agreement filed by the parties on September 12, 1997, and completed by submission of negotiated language for provisions 2B and 2D on October 15, 1997, is approved, effective on the date specified in the agreement.
