DISPOSITION: EXECUTED INTERCONNECTION AGREEMENT APPROVED

On February 14, 1997, the Commission issued Order No. 97-052 approving the arbitration decision issued by Arbitrator Samuel J. Petrillo in this proceeding. On April 15, 1997, U S WEST Communications, Inc. (USWC) filed an application for reconsideration of Order No. 97-052.

On May 19, 1997, USWC and Sprint Communications Company L.P., filed a copy of an interconnection agreement executed pursuant to the arbitration.

On May 30, 1997, the Commission issued Order No. 97-194 denying USWC’s application for reconsideration of Order No. 97-052.

Section 251(e)(1) of the Communications Act of 1934, 47 U.S.C. 151 et seq., as amended by the Telecommunications Act of 1996 (Act), requires that any interconnection agreement adopted by negotiation or arbitration shall be submitted for approval to the State commission. Section 252(e)(2)(B) provides that the State commission may reject an agreement (or any portion thereof) adopted by arbitration only "if it finds that the agreement does not meet the requirements of section 251, including the regulations prescribed by the Commission pursuant to section 251, or the standards set forth in subsection (d) or this section."

The Commission concludes that the interconnection agreement comports with the requirements of the Act, the Federal Communications Commission rules where applicable, and relevant state laws and regulations, and should be approved.

ORDER

IT IS ORDERED that the Interconnection Agreement filed by U S WEST Communications, Inc. and Sprint Communications Company L.P. on May 19, 1997, is approved. As specified in Order No. 97-052, the interconnection agreement shall become effective five business days after the date of this order.
