DISPOSITION: APPLICATION FOR RECONSIDERATION DENIED

On September 20, 1996, Sprint Communications Company L.P., (Sprint), filed a petition with the Public Utility Commission of Oregon (Commission) to arbitrate a contract for network interconnection with U S WEST Communications, Inc., (USWC) pursuant to 47 U.S.C. §§251 and 252 of the Communications Act of 1934, as amended by the Telecommunications Act of 1996 (Act).

An arbitration hearing was held on December 9, 1996, in Salem, Oregon before Samuel J. Petrillo, Administrative Law Judge. On December 23, 1996, the parties filed post hearing briefs.

On January 15, 1997, the Arbitrator issued a decision resolving the disputed issues in this proceeding. USWC and Sprint filed comments regarding the Arbitrator’s decision on January 27, 1997.

On February 14, 1997, the Commission issued Order No. 97-052 approving the Arbitrator’s decision.

On April 15, 1997, USWC filed an application for reconsideration of Order No. 97-052. USWC requests that the Commission reconsider those portions of Order No. 97-052 relating to interim number portability, cross-class resale restrictions, and the purchase of unbundled elements.

The Commission has reviewed USWC’s application. We find that Order No. 97-052 is consistent with the requirements of the Telecommunications Act of 1996, applicable Federal Communications Commission regulations and relevant state law and rules. Accordingly, we conclude that USWC’s application for reconsideration should be denied.

ORDER

IT IS ORDERED that:

1. The application of U S WEST Communications, Inc., for reconsideration of Order No. 97-052 is denied.

2. U S WEST Communications, Inc., and Sprint Communications Company L.P., shall submit for Commission approval an executed interconnection agreement consistent with the terms of Order No. 97-052. The interconnection agreement shall become effective five business days after the Commission issues an order approving the agreement.
