DISPOSITION: SUSPENSION PERIOD EXTENDED

On August 18, 1996, First Hill Water, Inc. (First Hill), filed rate schedules to be effective September 19, 1996. At its September 10, 1996, public meeting, the Public Utility Commission of Oregon found good and sufficient cause exists to investigate the propriety and reasonableness of the rates pursuant to ORS 757.210 and 757.215. The Commission ordered suspension of the rate schedules pending that investigation. The suspension period was due to end on March 19, 1997.

By memorandum dated February 25, 1997, Staff informed the Commission that First Hill had not provided sufficient responses to Staff’s data requests to allow Staff to form a fair and reasonable recommendation regarding rates for the company. Staff also informed the Commission that it is working toward a long term solution that would involve either the City of Bend providing water service to the customers or the customers taking over the First Hill system. However, Staff asserts that neither alternative is ready to present to the customers. Therefore, Staff requests an extension of the suspension period by an additional three months.

Staff’s request is reasonable and will be granted.

ORDER

IT IS ORDERED that the suspension period for First Hill’s rate case is extended by an additional three months. The suspension period will now end on June 19, 1997.

A request for rehearing or reconsideration must be filed with the Commission within 60 days of the date of service of this order. The request must comply with the requirements in OAR 860-14-095. A copy of any such request must also be served on each party to the proceeding as provided by OAR 860-13-070(2). A party may appeal this order to a court pursuant to ORS 756.580.
