ORDER

DISPOSITION: RULES AMENDED

At its September 24, 1996, public meeting, the Commission initiated this rulemaking proceeding to amend OAR 860-033-0030 and 860-033-0050. The proposed amendment establishes a requirement that individuals claiming eligibility for the Oregon Telephone Assistance Program (OTAP) and Link-Up America supply Social Security Numbers as a means of identification. The Social Security Numbers are used by Staff to verify income of the applicants.

On September 24, 1996, the Oregon Public Utility Commission filed a Notice of Proposed Rulemaking with the Secretary of State and served it on all interested parties. The notice set out the proposed action and included a Statement of Need, Statutory Authority, Principal Documents Relied Upon, Economic and Fiscal Impact, and an Advisory Committee statement. The notice invited interested persons to file written comments or request a hearing. The Secretary of State published notice of this action in the Oregon Bulletin.

One supporting comment was filed by GTE Telephone Operations. No one requested a hearing, nor were any opposing comments received.

At its public meeting on January 7, 1997, the Commission approved the amendments recommended by staff. Appendix A, which is attached to this order, sets out the full text of the amended rule.

ORDER

IT IS ORDERED that OAR 860-033-0030 and 860-033-0050 as set forth in Appendix A are approved. This action shall be effective upon filing with the Secretary of State.
