DISPOSITION: PETITION DISMISSED

 

On August 1, 1996, TCG Oregon (TCG) filed a petition for arbitration for an interconnection agreement between TCG and GTE Northwest Incorporated (GTE). On September 9, 1996, TCG filed a motion to withdraw its petition for arbitration. The motion was accompanied by a copy of a letter agreement between TCG and GTE memorializing their agreement to TCG's withdrawal of the petition. TCG and GTE agree that TCG may initiate new interconnection negotiations, and that its rights to arbitration of those negotiations will not be prejudiced by dismissal of Docket Number ARB 4. TCG and GTE further agree that any new negotiations will be initiated by letter request from TCG and that such a request will trigger new timelines under the Telecommunications Act of 1996.

 

The parties have agreed to restart interconnection negotiations. Perhaps they will be successful in negotiating an interconnection agreement. The petition for arbitration should be dismissed.

 

 

ORDER

 

IT IS ORDERED that the petition for arbitration filed by TCG Oregon on August 1, 1996, to establish an interconnection agreement with GTE Northwest Incorporated, is dismissed.
