On August 16, 1996, AT&T Communications of the Pacific Northwest, Inc. (AT&T) filed a motion for a protective order pursuant to OAR 860-012-0035(1)(k).
AT&T seeks a protective order in this docket because the proceeding will involve the rates, terms, and conditions for resale, interconnection, collocation, unbundled network elements, real-line electronic interfaces, and various additional aspects of interconnection between AT&T and U S WEST Communications, Inc. (USWC). AT&T anticipates that USWC will request confidential and proprietary information from AT&T regarding those issues, and AT&T has requested that USWC produce cost studies and other information that USWC considers confidential and proprietary. AT&T asserts that without a protective order, there is a significant risk that confidential and proprietary information could be disclosed, with resulting competitive harm.
AT&T has made a prima facie showing of good cause to issue a protective order in this proceeding. This protective order and the information protected by it is subject to all the provisions set forth in Appendix A. Parties agreeing to be bound by the terms of the protective order shall sign the signatory page of Appendix B.
The AT&T\USWC arbitration in docket ARB 3 has been consolidated with the MCImetro|USWC arbitration in docket ARB 6. The terms of the protective order shall apply to both dockets.
NOTICE
Any party in this proceeding may appeal to the Commission for relief from any term of this Protective Order by filing a complaint with the Commission as provided in OAR 860-013-0015. Parties benefiting from this Protective Order may respond as provided by Commission Rules of Practice and Procedure. For good cause shown, the Commission may establish expedited procedures for ruling on any such appeal.
ORDER
IT IS ORDERED that the Standard Protective Order, attached as Appendix "A," shall govern disclosure of confidential information in this case.
