On July 19, 1996, the Public Utility Commission of Oregon (Commission) issued Order No. 96-188, requiring U S WEST Communications, Inc. (USWC), and GTE Northwest Incorporated (GTE) to unbundle their telecommunications services into network building blocks. Order No. 96-188 establishes prices for the authorized building blocks and addresses issues relating to jurisdiction, imputation, network access channel deaveraging, pricing, use and user restrictions, wholesale rates, and revenue requirement calculation.

 

On August 8, 1996, the Federal Communications Commission (FCC) promulgated rules to implement Sections 251 and 252 of the Telecommunications Act of 1996 (the Act). The FCC order, designated FCC 96-325, is approximately 700 pages in length and addresses many of the issues dealt with in Commission Order No. 96-188.

 

The Act and the FCC order require state commissions to undertake a variety of tasks to implement the requirements of Sections 251 and 252. States may not adopt policies that are inconsistent with the Act.

 

The Commission will undertake a review of Order No. 96-188 to determine if it is consistent with the Act and the rules adopted by the FCC. Parties are invited to submit written comments specifying any revisions that must be made to Order No. 96-188. The comments must set forth the specific part or parts of Order No. 96-188 that require revision, and must include citations to the Act and FCC order 96-325 in support of the requested change. Each issue should be set forth on a separate page or in a separate section. Comments must be filed with the Commission no later than September 23, 1996.

The Commission recognizes that some parties may seek reconsideration of Order No. 96-188 on grounds unrelated to the Act or FCC order 96-325. Under ORS 756.561, such requests must also be filed by September 23, 1996. Any party submitting comments regarding the Act or the FCC decision, may also request reconsideration on other grounds. Such arguments should be set forth in a separate section and should clearly indicate that they do not relate to the Act or the FCC decision.

 

Copies of the confidential workpapers used to develop the building block rates contained in Appendix C of Order No. 96-188 may be obtained from the Commission by any party that has signed the protective order issued in this proceeding.

 

Pending the review authorized herein, the tariff filing requirements in Order No. 96-188 are suspended.
