DISPOSITION: APPLICATIONS DISMISSED
In each of the subject dockets, the Commission received an application pursuant to ORS 757.480, requesting approval of the sale of an individual water company.
In Order No. 95-1207 (November 20, 1995), the Commission concluded it does not have jurisdiction over water companies which (1) have fewer than 300 customers; (2) charge $18 or less per month, and (3) provide adequate and nondiscriminatory service. (ORS 757.005(1)(E).)
Commission staff investigated each of these applications and finds that, in each instance, the water company being sold has fewer than 300 customers, charges less than $18 per month, and has had no complaints or petitions filed with the Commission claiming that the service would be inadequate or discriminatory as a result of the sale.
IT IS THEREFORE ORDERED that the following applications are dismissed:
UP 116, In the Matter of the Application of Haner Water System for an Order Authorizing its Sale to Rainbow Ends Water District; UP 117, In the Matter of the Application of Avion Water Company, Inc., for an Order Authorizing the Purchase of Ridgestone Water System; UP 118, In the Matter of the Application for an Order Authorizing the Sale of Twin Oaks Water System; and UP 121, In the Matter of the Application of Watermasters, Inc. for Approval to Purchase Marina Water Company from Mildred Kloehn.

A party may request rehearing or reconsideration of this order pursuant to ORS 756.561. A request for rehearing or reconsideration must be filed with the Commission within 60 days of the date of this order. The request must comply with the requirements of OAR 860-14-095. A copy of any such request must also be served on each party to the proceeding as provided by OAR 860-13-070(2)(a). A party may appeal this order to a court pursuant to ORS 756.580.
