DISPOSITION: PETITION APPROVED
On July 12, 1995, Clear Creek Mutual Telephone Company (Clear Creek) filed an application for an order to amend its local exchange boundaries. Clear Creek and the Beaver Creek Cooperative Telephone Company (Beaver Creek) have agreed to trans-fer one quarter square mile, specifically the southwest quarter of Section 13, T3S, R2E, from Beaver Creek to Clear Creek.
On August 11, 1995, Beaver Creek filed a letter concurring in the application.
The territory involved in the transfer is presently vacant land which is to be developed as Beaver Lake Development, a residential development. This territory is presently divided into two allocated service areas, one served by Clear Creek and one served by Beaver Creek. The effect of the proposed transfer would be to allow Clear Creek to provide telephone and cable services to the entire residential development.
Attachment A to this order is a revised metes and bounds description of Clear Creeks exchange boundary. It also contains Clear Creeks revised exchange maps. Attachment B to this order is a revised metes and bounds description of Beaver Creeks exchange boundary. It also contains Beaver Creeks revised exchange maps.
The Commission published a notice of the petition pursuant to ORS 758.420. No request for a hearing was filed. Based on the application, the Commission concludes that the agreement will promote the efficient and economic use and development of the utility systems of the parties to the agreement, while providing adequate and reasonable service to the territories and customers affected by the agreement. The agreement should be approved.
ORDER
IT IS ORDERED that:
1. The applications of Clear Creek Mutual Telephone Company and Beaver Creek Cooperative Telephone Company for allocation of service territories and amendment of service boundaries are approved.
2. The area described in this order is allocated for service to Clear Creek.
3. Clear Creek shall amend its service boundary to include the area described in this order.
4. The revised exchange maps attached to this order for Clear Creek and Beaver Creek are approved.
