ORDER

DISPOSITION: OREGON CUSTOMER ACCESS PLAN AMENDED

 

 

In Order No. 93-1133, the Commission adopted a 1994 Oregon Customer Access Plan (OCAP).

 

On February 3, 1995, the Oregon Exchange Carrier Association (OECA) filed a petition asking the Commission to amend Part IX-A of the OCAP.

 

The existing text of Part IX reads as follows:

 

Part IX: Optional Pooling and Filing Frequency:

 

A. Participation in the OCAF or OUSF shall be optional for LECs on a year-to-year basis. However, DXC(s), PTCs, and IXCs are not eligible for participation in OCAF or OUSF. Any LEC deciding not to participate for a future rate year shall notify the OPUC and OECA in writing of its decision by January 1 of the rate year in question. OECA shall provide notification to its telecommunications service list of those LECs electing not to participate.

 

The OECA petition would have amended the text to read as follows:

 

Part IX: Optional Pooling and Filing Frequency:

 

A. Participation in the OCAF or OUSF shall be optional for LECs on a year-to-year basis. However, DXC(s), PTCs, and IXCs are not eligible for participation in OCAF or OUSF. Any LEC deciding not to participate for a future rate year shall notify the OPUC and OECA in writing of its decision by March 1 with respect to 1995 and by February 15 in subsequent years. OECA shall provide notification to its telecommunications service list of those LECs electing not to participate.

 

On February 8, 1995, the staff of the Public Utility Commission filed comments that opposed, in part, the petition. Staff set out an alternative proposal. On February 10, 1995, OECA filed a letter supporting staff’s recommended modification and withdrawing its petition. Staff’s proposal is as follows:

No other entity filed comments on the proposed modification.

 

OPINION

 

The Commission has examined the modification recommended by staff and concludes that it is appropriate.

 

ORDER

 

IT IS ORDERED that Part IX-A of the 1994 Customer Access Plan adopted in Order No. 93-1133 is amended to read as follows:

 

Part IX: Optional Pooling and Filing Frequency:

 

A. Participation in the OCAF or OUSF shall be optional for LECs on a year-to-year basis. However, DXC(s), PTCs, and IXCs are not eligible for participation in OCAF or OUSF. Any LEC deciding not to participate for a future rate year shall notify the OPUC and OECA in writing of its decision by February 15 for rate years beginning in 1996. A request for rehearing or reconsideration must be filed with the Commission within 60 days of the date of this order. The request must comply with the requirements of OAR 860-14-095. A copy of any such request must also be served on each party to the proceeding as provided by OAR 860-13-070(2)(a). A party may appeal this order to a court pursuant to ORS 756.580.
