ALJ BERGEN issues memorandum.
On November 5, 1998, Columbia River People's Utility District (CRPUD) filed a petition for a declaratory ruling pursuant to ORS 756.450. On January 4, 1999, CRPUD requested that this proceeding be held in abeyance with no further processing until CRPUD requests the proceeding commence again. No party filed a response to the request and I granted it on January 20, 1999. On January 28, 1999, PGE filed a motion for clarification of my ruling. The Commission responded by issuing Order No. 99-199.
It has been more than a year and a half since the proceeding was put in abeyance. It is time to process the case or dismiss it. I request CRPUD to respond by October 13, 2000, stating whether it wants to proceed with this docket. If no response is filed, I will prepare an order dismissing this proceeding.
