How many longstanding, unrepaired leaks are considered acceptable before a regulated utility is no longer providing "safe and adequate service"? 2. Has anyone determined whether prolonged leaks have affected system pressure or fire flow reliability? 3. When was Parkdale Water's most recent comprehensive leak survey? What percentage of Parkdale's water produced is currently considered unaccounted-for water? 4. Has the Commission evaluated whether continuous deferred maintenance creates future risks for water quality or system reliability? 5. When was Parkdale Water's last system-wide inspection? 6. Can the Commission assure Parkdale Water customers today that there are no additional infrastructure failures waiting to occur? 7. Staff documented that Parkdale Water delayed responding to Commission inquiries despite legal obligations to provide records and information. This has been the bases of several customer complaints as well. If Parkdale Water fails to respond promptly to its own regulator, what confidence should customers have that future safety concerns will be addressed promptly? How can the Commission effectively regulate a utility that repeatedly fails to cooperate with its regulator? 8. How will the Commission measure whether Parkdale Water complies with Oregon regulations going forward if there is no investigation? 9. If this investigation is opened, will the Commission examine not only individual incidents, but also whether Parkdale Water has adequate management practices, recordkeeping, maintenance planning, and customer communication procedures? 10. If the Commission declines to investigate despite findings from its own Staff, repeated customer complaints, reports from Hood River County, ODOT, Oregon Health Authority, Department of Justice involvement, and documented infrastructure failures--including a failed Feasibility Study performed by PACE Engineers in 2021, what additional evidence would ever justify opening an investigation? |
